Community citizens:

Citizens of the European Union have the right to stay in the Italian territory for a period not exceeding three months, without any conditions and formalities, except in possession of a valid identity document for expatriation issued by the country of origin.

Non-EU citizens:

  4. For non-EU family members: passport and residence card issued by the Police Headquarters.

Therefore, pursuant to the civil code, residence is the place of habitual residence, that is, the place where family and social life usually takes place (Ministry of the Interior Circ. No. 21/2001).

A precise and current definition of the registered residence can be found in a sentence of the Civil Court of Cassation, Section II, of 14 March 1986, n. 1738: "The residence of a person is determined by his habitual and voluntary abode in a specific place, that is, by the objective element of permanence in that place and by the subjective element of the intention to live there permanently, revealed by the habits of life and by the carrying out normal social relations; this stable permanence also exists when the person goes to work or to carry out other activities outside the municipality of residence, as long as he keeps his home there, returns there whenever possible and maintains the center of his family relationships there and social. "

The registered residence or habitual residence involves registration with the registry office of the municipality where you wish to establish your residence and this declaration must be presented within 20 days of the transfer, in turn the office is obliged to means of affixed officers, usually of the Local Police, to verify the residence requirement and the existence of the residence title such as property, usufruct, lease, loan for use, etc. .. In the event that there are no emotional or kinship ties, it is possible to request separate family status.

Declarations relating to minors can only be submitted by those who exercise parental authority or guardianship.

In case of entry into a cohabitation (boarding school, boarding school, barracks, etc.) it is the cohabitation manager who makes the request for registration.

With the declaration of residence, the Municipality communicates the new address to the motorization for updating the archive of authorized drivers and the national vehicle archive. It is no longer possible to print and send the update slip of the residential address on either the driving license or the vehicle registration document.

Following the change of residence, the identity card will not be reissued with the new address, as this can only happen upon expiry.

Documentation to be submitted

  5. If the family unit comes from abroad, it is necessary to show a passport or equivalent document (identity card for Italian citizens and citizens of other EU countries).
  6. If a non-EU citizen submits the residence request, the valid residence permit must also be attached;
  7. If the applicant is a foreign EU citizen, an employment contract must also be attached; hiring communication to the employment center (INPS for domestic worker); last paycheck (payment of social security contributions for domestic collaboration); cud (for domestic collaborators, declaration by the employer relating to the salary of the previous year) o Documentation certifying the possession of sufficient economic resources or self-declaration made pursuant to the D.P.R. 445/2000 and documentation certifying the ownership of a health insurance policy or registration with the National Health Service.
  8. Any suitable documentation issued by the competent Italian consular or diplomatic authority certifying the relations of kinship between the members of the family (if it is not presented, the declaration of residence is still received but the kinship relations are not indicated)

The registry officer must make the required changes within two working days following the submission of the request, the legal effects of which will run from the date of the declaration. From that moment it will be possible to issue certificates of residence or other certificates relating to data that can be documented up to that moment.

The Municipality of registration will have 45 days from the date of the declaration to carry out the relative checks on the declarations and to ascertain whether the habitual residence of the applicants is where it was actually declared.

In the case of negative assessments or verification of the absence of requirements, the Municipality must suspend the terms of the procedure and communicate to the interested parties the outcome of the checks and the possibility that the request may have a negative outcome (Article 10 bis of Law no. .241 / 1990).

Interested parties, from receipt of the communication, will have 10 days to communicate observations or additions to the application to the municipality.

• If the Municipality receives communications, observations or documentation from the interested parties within the established terms, the terms of the procedure will resume after 10 days of receipt.

• If within 10 days of receipt by the interested parties, no communication, observation or documentation is received by the Municipality, the terms of the procedure will resume from that date.

In the event that no communication to the citizen is sent within the time required for the checks (45 days from the request), the residence is considered confirmed on the basis of the principle of tacit consent. The Municipality can, however, if it deems it, proceed to further investigations.
